Manage contracts

The purpose of this competency is to achieve the goals of contract management, i.e. to:

  • support procurement by negotiating terms and conditions;
  • document contractual agreements;
  • monitor contractual performance;
  • conclude contracts.

Performance criteria

You must be able to:

  1. plan and initiate contracts
  2. negotiate contract terms and conditions
  3. adapt standard terms and conditions
  4. develop and maintain contract documentation
  5. assure the quality of contract management

In more complex situations a P3 manager may need advice on contract law from lawyers. The more critical and complex the legal relationships, the more dependent the manager will be on this advice.

The key word here is ‘advice’, it will still be the manager’s responsibility to decide how to act upon the legal advice.

Depending upon the context, this competency may need to be amended to reflect the relationship between the manager and the legal advisors.

Knowledge and understanding

You need to know and understand:

  1. the principles and goals of contract management
  2. responsibilities for contract management
  3. the context of the work and its impact on contracts and contractual relationships
  4. a procedure for managing contracts
  5. the purpose and content of contract documentation
  6. relevant standard forms of contract
  7. legal terminology such as ‘offer and acceptance’ and ‘consideration’
  8. how assurance applies to contract management
